Marco Vivaldi will supply photographic reproductions and arrange delivery to customers who accept the following terms and conditions.
Definitions:

For the purpose of this agreement these terms have the following meanings:

'we, our' refers to Marco Vivaldi and the staff of MV-Photography
'you' means the purchaser or buyer entering into this purchase contract
'goods' means the works of art including books, calendars, prints, photographs supplied through this agreement as a complete order
'reproduction' means a photograph, print or other item, produced by Marco Vivaldi

- Copyright for the original work of art remains with the artist Marco Vivaldi. You may not reproduce the work in any form without a written licence from the copyright holder.

- Ordering: to place an order we recommend using our on-line shopping. Simply select the image you would purchase, when the windows popup appear with the enlarged image, select 'Cart' and choose the number of the print in the preferred sizing. To place any orders, you have before to register your data in 'Registration' menu (read our 'Privacy' policy about the treatment of your personal data). This brief operation is necessary only the first time and will take very few time. Once registered, you will receive an email with a link to confirm your data. Once confirmed, by your email and your password, you will be able to login. By your 'Login' menu you will be able to change your personal data, submitting, confirming and deleting your orders and following the entire order process. Your account will be valid for 365 days.

- Prices are calculated to include the price of reproduction.

- When your order has been successfully completed, you have to submit the order selecting 'Check out and Orders management' in your 'Login' menu or clicking on the confirmation link in the email that we will send you at the address you have provided with all details (products, quantities, costs and delivery details) of your order. During the confirmation process you will be able to delete the order.

- We reserve the right to make adjustments to goods and their prices to take into account any changes from our suppliers, any imposition of new taxes or duties or if there is an error or omission in the price published on our web site. In this instance we will inform you of the correct price and ask you to confirm the order.

- All goods have been fairly described, however limited edition works of art are individually created so texture and colour may vary within an edition. The colours you see on screen will depend on your computer's monitor settings. Consequently there may be some difference between the goods you receive and the image on your screen.

- Once confirmed and payed the order from you, we will proceede with the delivery. Goods (prints and calendars) will normally be prepared within 3 days from your payement unless otherwise specified by you, but we will not be liable for any delay in delivering (estimated in 6 working days) the goods. We will provide you, if possible, the informations to track the delivery (courier and delivery code).

- We will only deliver to the countries specified. You must warrant to Marco Vivaldi that you are resident and accessing the Marco Vivaldi website from the country of billing and delivery.

- You will be required to sign for the goods to confirm delivery of your order.

- We operate a returns policy. If you are not satisfied with your work of art you have to follow the instructions that we will send you in the email with the subject 'Order xxxxxxxx delivered dd/mm/yyyy'. You have to return us the goods securely packaged (at your own expense). A refund (we cannot refund shipping, handling and PayPal taxes. These last ones are about 4,5 % of the amount of the order) will then be issued provided the goods are returned in their original condition (saleable condition), including packaging (remember to preserve the email concerning the details of the delivery. In this email you can find the procedure for asking a refund).

- As soon as the goods are delivered you are responsible for their care and conservation, including ensuring that the appropriate heating and lighting conditions are provided.

- We accept payment through the secure web site from PayPal or Bank/Wire money transfer. For other payment methods please contact our customer support team by 'Contact us' in the home page of Marco Vivaldi web site.

- As a customer you will be liable for any import duty fees or taxes arising from deliveries outside the EC. Marco Vivaldi will not be liable for any delays caused by non-payment.

- Our liability save in the case of death or personal injury in this contract is limited to the purchase price of the goods, and we are not liable for indirect or consequential loss or damage or any loss of data, profit, revenue, income or business, however caused, even if foreseeable.

- At our discretion and without assigning a reason, we may refuse or delay serving an order. To assist with any queries relating to any order please ensure that your correct contact details are provided.

- At our discretion the web site will be closed some days during the year. During the closing period will be not possible register new customer accounts, submit/confirm orders and submit new links. We advice you some days before the closing period.

- You confirm that you are over 18 years of age, and legally capable of entering into this agreement.

- We will not be liable for any delay in providing goods caused by circumstances beyond our reasonable control.

- The governing law for this agreement is the law of Italy and any disputes will be dealt with exclusively in the courts of Italy. If you have a complaint or dispute you should first contact us by 'Contact us' in the home page of Marco Vivaldi web site.

- We reserve the right to make changes to our site and these conditions of use at any time. If any of these conditions shall be deemed invalid or unenforceable for any reasons, that condition shall be deemed not to form part of this agreement and the enforceability of the remainder of this agreement shall not be affected.
